Purpose of the Website

Our website is provided for the purpose of selling OZtrail products and services and providing related information about outdoor equipment. While we strive to ensure the accuracy of the information presented, we do not warrant that it is free from error and reserve the right to correct inaccuracies when identified.


Liability and Indemnity

OZtrail does not exclude any rights or remedies available under the Australian Consumer Law or similar State or Territory legislation that cannot be excluded, restricted, or modified.

To the extent permitted by law, OZtrail's liability for any implied warranty or condition that cannot be excluded is limited to the following:


For goods supplied:

  • Replacement or repair of the goods, or the supply of equivalent goods.
  • Payment of the cost of replacing or repairing the goods.


For services supplied:

  • Re-supply of the services.
  • Payment of the cost of having the services re-supplied.

Under no circumstances will OZtrail be liable for any indirect, incidental, special, or consequential losses or damages, including but not limited to:

  • Inability to access or use the website or any material on the website.
  • Unauthorized access to or alterations of your transmissions or data.
  • Statements or conduct of any third party on the website.

Benefits and Promotions

BenefitsĀ include discounts and promotions on items available through OZtrail's website atĀ www.oztrail.com.au. The following terms apply to all Benefits and Promotional Activities:

  1. Eligibility:Ā Benefits are offered to Australian residents aged 18 or older.
  2. Usage:Ā You are entitled to one Benefit per transaction at the time of purchase or unless specified. Benefits must be redeemed at the point of sale and cannot be applied retrospectively.
  3. Non-Transferable:Ā Benefits cannot be sold, transferred, or assigned and are not redeemable for cash or any other instruments, including gift vouchers, gift cards, cheques, and credit notes.
  4. Amendments:Ā OZtrail reserves the right to vary, withdraw, or cancel Benefits and Promotional Activities at any time without prior notice.
  5. Expiry:Ā All Benefits have an expiry date, after which they will no longer be valid. OZtrail reserves the right to change the expiry date of any Benefit without prior notice.
  6. Liability:Ā OZtrail will not be held responsible or liable if Benefits are not able to be redeemed due to technical failures or any other reason beyond our control.


Specific Promotional Terms

1. Free Gifts

Terms:Ā Free gifts are available only with the purchase of qualifying items in a single transaction. Limit one free gift per transaction. If the qualifying item is returned, the value of the free gift will be deducted from the refund if it is not returned in its original, unused condition.

2. Product Bundles

Terms:Ā Bundle discounts apply only to items purchased together within the bundle offer. Returns on individual items in the bundle may void the discount, with refunds adjusted based on non-bundle prices. All items in the bundle must be returned together with all the original packaging and in the original condition to receive a full refund.

3. Add-On Savings

Terms:Ā Add-on savings are applicable only when the add-on item is purchased in the same transaction as the qualifying item. If the qualifying item is returned, the add-on discount will be removed, and the price difference for the add-on item will be deducted from the refund.

4. Build Your Own Bundle

Terms:Ā Discounts for custom bundles apply only when the specified minimum number of eligible items is purchased together. Returning any items from this bundle may void the discount, with the price difference deducted from the refund.

5. Product Volume Discounts

Terms:Ā Volume discounts apply only when the specified minimum quantity of eligible items is purchased in one transaction. If any items from the discounted set are returned, the refund will be recalculated based on the standard price of the remaining items.

6. Free Shipping Offers

Terms:Ā Free shipping on orders over a specified amount is valid for eligible items only. If items are returned that reduce the order total below the required amount, the standard shipping cost will be deducted from the refund.

7. Buy X Get Y Promotions

Terms:Ā The Buy X Get Y offer is limited to one free item per customer per order. If the qualifying item is returned, the free item must also be returned in its original condition, or its retail value will be deducted from the refund.

8. Discount Bundles

Terms:Ā Bundle discounts apply only when all specified items are purchased together. If individual items within the bundle are returned, the bundle discount will be voided, and the refund will be adjusted based on non-bundle prices.

9. Sign-Up Discounts

Terms:Ā Sign-up discount codes are for first-time purchases only and cannot be combined with other promotions. Codes are single-use, non-transferable, and expire after a set period from the sign-up date.

Returns and Exchanges

In the event you return or exchange an item that a Benefit was applied to, the following terms apply:

  • Forfeiture of Benefits:Ā Any Benefits applied to the original purchase will be forfeited upon return or exchange.
  • Refund Adjustments:Ā If the qualifying item is returned without the promotional item (e.g., free gift), the value of the promotional item will be deducted from the refund.
  • Exchanges for Lesser Value:Ā If exchanging for an item of lesser value, the original Benefit will not transfer, and the price difference will not be refunded.
  • Bundle Returns:Ā All items in a bundle must be returned together to receive a full refund. Returning individual items may void the bundle discount, and refunds will be adjusted accordingly.

Privacy and Communication

By using this website, you accept OZtrail's Privacy Policy. OZtrail will not accept any liability for any email communication that is misdirected, lost, or not received. We are not liable for any technical issues, including but not limited to network failures, computer systems, servers, providers, or software malfunctions that may occur.

Competition and Consumer Act Compliance

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies available under theĀ Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or any other applicable legislation that cannot be excluded, restricted, or modified. To the extent permitted by law, if OZtrail incurs a liability, it is limited to:

  • Supplying equivalent goods or services.
  • Payment of the cost of supplying equivalent goods or services.

Entire Agreement

This Agreement is to be read in conjunction with any additional conditions associated with Benefits or Promotional Activities. In the event of any discrepancies, OZtrail's decision in its absolute discretion will be final and binding.

OZtrail's decision in relation to all matters arising concerning Benefits and Promotional Activities is final and binding.

This Agreement is governed by the laws of Queensland, Australia. Any disputes will be resolved under the jurisdiction of the courts of Queensland. You may not assign or transfer any rights under this Agreement without OZtrail's written consent.
